Social Media Policy and Guidelines

Please read the following Social Media Policy and Guidelines (“Policy”) before using any social media site of WESTMED Medical Group (“WESTMED”), including WESTMED’s Facebook page, blogs or other user generated content sites (“Social Media Sites”). By posting comments or content to, or accessing or viewing any Social Media Site, you agree to be bound by the Policy. WESTMED may change the Policy at any time without notice by updating this posting, so you should periodically visit this page to review the current Policy. Each time you post to, access or view a Social Media Site, you will be bound by the posted Policy in effect at that time.

1. WESTMED’s Social Media Sites are meant to provide general information about WESTMED Medical Group. Content on WESTMED’s Social Media Sites is NOT medical advice and should not be relied upon for this purpose.

2. WESTMED welcomes comments on its Social Media Sites, but insists that all comments be honest, in good taste and respectful. Comments that are, in WESTMED’s sole discretion, defamatory, offensive, obscene, inflammatory, threatening, embarrassing, repetitive or otherwise inappropriate or objectionable are not permitted.

3. Do not post any personal health information or other confidential information. All postings will be publicly available on the Internet without protection of any kind.

4. You must be at least 18 years old to post any content on a Social Media Site. Use of another person’s identity or allowing another person to use your identity for the purpose of posting, accessing or viewing content is forbidden.

5. You may not post, upload or otherwise transmit any of the following: content that provides medical advice; links to other sites; recommendations, comments or other information concerning persons or entities unrelated to WESTMED; promotional materials; or any content that infringes on intellectual property, privacy or other rights of any third party.

6. WESTMED reserves the right to review all content, including photographs and videos, before it is posted and to reject, edit or remove any content at any time, as WESTMED deems appropriate in its sole discretion. WESTMED further reserves the right to monitor, restrict, block, prohibit, suspend or terminate your access to its Social Media Sites without notice at any time, for any or no reason, in its sole discretion.

7. By posting any content to a WESTMED Social Media Site, you give WESTMED the irrevocable right to use, reproduce, distribute, transmit, publish and display such content and the right to create derivative works from your content, edit or modify such content and use such content for any WESTMED purpose.

8. You are solely responsible for any content you post on a WESTMED Social Media Site. You assume all security, privacy, confidentiality and other risks with respect to posting to, or using, accessing or viewing a Social Media Site, including but not limited to intrusion attempts, compromises to your information, viruses, worms and other risks. WESTMED is not obligated to monitor or review any posted content and will have no liability of any kind related to any posting to, or any use, access or viewing of, WESTMED’s Social Media Sites.

9. You agree to indemnify and hold harmless WESTMED Medical Group, its directors, officers, physicians, employees, agents, successors and assigns against any and all damages, losses, liabilities, judgments, claims, causes of action, costs or expenses (including but not limited to reasonable attorneys’ fees) arising out of, based on or in any way connected with any content you have posted on the Site or your use of, access to or viewing of any Social Media Site.

10. If you are a WESTMED employee or staff member you must adhere to WESTMED’s Electronic Communication Systems policy (posted on WESTMED’s Intranet) as well as this Policy.
